Voluntary Participation Policy

Participating in any museum activity is completely voluntary. By means of participation, the participant and any minors in their party understand that some museum activities, materials, and equipment may have inherent risks, dangers, and hazards. While unlikely, injury or illness that could cause disability or death may occur, particularly as a result of negligence, carelessness, accidents, breaches of contract, forces of nature, or other causes that are both foreseeable and not foreseeable. Concerns about fitness for participation should be addressed with a healthcare professional. Should a participant feel unsafe, uneasy, or unwell at any time during a museum activity they should discontinue participation immediately.  Participants assume all risks and dangers and as well as all responsibility for any losses and/or damages. Participants, minors in their care, and their heirs voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify The Nelson Gallery Foundation dba The Nelson-Atkins Museum of Art, and its board, agents, officers, employees, staff, volunteers, or docents from any and all claims. The venue of any dispute that may arise between the parties to which the museum or its agents is a party shall be Jackson County, Missouri.

BY PATICIPATING IN MUSEUM ACTIVITIES THE PARTICIPANT AGREES IT IS THEIR INTENTION TO EXEMPT THE NELSON-ATKINS MUSEUM OF ART FROM LIABILITY.
